ART2LIVE, S.L., in application of the regulations in force on the protection of personal data, informs you that the personal data collected through the forms on the Website: https://www.mestis.es are incorporated into specific automated files for users of the services of ART2LIVE, S.L.

The collection and automated processing of personal data are intended to maintain the business relationship and to carry out information, training, advisory and other activities specific to ART2LIVE, S.L.

This data will only be disclosed to those entities where necessary for the sole purpose of fulfilling the aforementioned purpose.

ART2LIVE, S.L. takes the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), which repeals the previous LOPD.

The user may, at any time, exercise the rights of access, objection, rectification, erasure, restriction and portability recognized in the aforementioned EU Regulation. The user declares that all data provided by them are true and correct, and undertakes to keep them up to date, notifying ART2LIVE, S.L. of any changes.

Purpose of processing personal data

For what purpose will we process your personal data?
At ART2LIVE, S.L., we will process your personal data collected through the Website: https://www.mestis.es for the following purposes:

  1. To provide our services in accordance with clients’ specific needs, in order to fulfil the contracts entered into.

  2. To send promotional information by electronic means.

  3. To provide the information requested by the user through the contact form.

  4. To manage data submitted by job candidates via their Curriculum Vitae (CV) or through the form provided in the “Work with us” section, for selection and recruitment purposes.

We remind you that you may object to the sending of commercial communications by any means and at any time by sending an email to the address indicated above.

The fields in these records are mandatory; the stated purposes cannot be achieved if such data are not provided.

How long are the collected personal data kept?

The personal data provided will be kept as long as the business relationship is maintained or you do not request their erasure, and for the period during which legal liabilities may arise from the services provided.

Lawful basis

Your data are processed on the following legal bases:

  1. Your request for information and/or the contracting of ART2LIVE, S.L.’s services, whose terms and conditions will in any case be made available to you prior to any potential contracting.

  2. Your free, specific, informed and unambiguous consent, insofar as we inform you by making this privacy policy available to you which, after reading it, you may accept—if you agree—by a statement or a clear affirmative action, such as ticking a box provided for that purpose.

If you do not provide your data, or if you provide them incorrectly or incompletely, we will be unable to process your request, making it impossible to provide the requested information or to enter into the service contract.

Recipients

Your data will not be disclosed to any third party outside ART2LIVE, S.L., except where required by law.

Data collected by users of the services

In cases where the user uploads files containing personal data to shared hosting servers, ART2LIVE, S.L. is not responsible for any failure by the user to comply with the GDPR.

Intellectual property rights — https://www.mestis.es

ART2LIVE, S.L. owns all copyrights, intellectual and industrial property rights, know‑how and any other rights related to the content of the website https://www.mestis.es and the services offered thereon, as well as the programs required for its implementation and the related information.

Reproduction, publication and/or use other than strictly private of the content, in whole or in part, of the website https://www.mestis.es is not permitted without prior written consent.

Software intellectual property

The user must respect third‑party programs made available by ART2LIVE, S.L., even if they are free and/or publicly available.

ART2LIVE, S.L. holds the necessary exploitation and intellectual property rights over the software.

The user does not acquire any right or licence, by virtue of the contracted service, over the software required to provide the service, nor over the technical information for monitoring the service, except for the rights and licences necessary to fulfil the contracted services and only for their duration.

For any action beyond performance of the contract, the user will require written authorization from ART2LIVE, S.L. The user is prohibited from accessing, modifying, or viewing the configuration, structure and files of the servers owned by ART2LIVE, S.L., and assumes civil and criminal liability for any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious action on their part.

Intellectual property of hosted content

Use of the services provided by ART2LIVE, S.L. contrary to intellectual property legislation is prohibited, in particular:

  1. Use that is contrary to Spanish law or infringes the rights of third parties.

  2. The publication or transmission of any content that, in the opinion of ART2LIVE, S.L., is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.

  3. Cracks, software serial numbers or any other content that infringes third‑party intellectual property rights.

  4. The collection and/or use of other users’ personal data without their express consent or in breach of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data.

  5. Use of the domain’s mail server and email addresses for sending unsolicited bulk email.

The user bears full responsibility for the content of their website, the information transmitted and stored, hypertext links, claims by third parties and legal actions relating to intellectual property, third‑party rights and child protection.

The user is responsible for compliance with the laws and regulations in force and the rules relating to the operation of the online service, e‑commerce, copyright, maintenance of public order, as well as universal principles of Internet use.

The user shall indemnify ART2LIVE, S.L. for expenses arising from proceedings in which liability is attributed to ART2LIVE, S.L. in any case where responsibility is attributable to the user, including fees and legal defence costs, even in the case of a non‑final court decision.

Protection of hosted information

ART2LIVE, S.L. makes backup copies of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the total restoration of data deleted by users, as such data may have been deleted and/or modified during the period since the last backup.

The services offered, except for specific backup services, do not include the restoration of content kept in backups made by ART2LIVE, S.L. when the loss is attributable to the user; in such cases, a fee will be set in line with the complexity and volume of the recovery, subject in all cases to the user’s prior acceptance.

The restoration of deleted data is included in the service price only when the loss of content is due to causes attributable to ART2LIVE, S.L.

Commercial communications

In application of the LSSI, ART2LIVE, S.L. will not send advertising or promotional communications by email or other equivalent electronic means that have not previously been requested or expressly authorized by their recipients.

In the case of users with whom there is a prior contractual relationship, ART2LIVE, S.L. is authorized to send commercial communications regarding ART2LIVE, S.L. products or services similar to those initially contracted with the client.

In any case, the user may, after proving their identity, request not to receive further commercial information through the Customer Service channels.
